MyHomeBuyerWise provides mortgage Loan Estimate auditing, educational analysis, and strategic communication templates designed to assist consumers in identifying potential lender markups and negotiable closing costs.

• No Financial or Legal Representation: MyHomeBuyerWise is not a mortgage broker, lender, real estate brokerage, law firm, or financial advisory institution. We do not offer legal, financial, or tax advice, nor do we originate, negotiate, or guarantee mortgage loans.
• Ghostwritten Communications: Any custom negotiation drafts or email templates provided by us are purely educational suggestions. You, as the user, maintain sole discretion and authorization over any communications, counter-offers, or documentation sent to your chosen mortgage lender.
• No Guarantee of Lender Acceptance: While our audits identify potential cost savings based on market standards, we do not control third-party mortgage lenders and cannot guarantee that a lender will accept, reduce, or waive any fees on your Loan Estimate.

A. DIY Audit Toolkit ($79 One-Time)

• Access: Provides immediate digital access to self-serve audit guides, fee identification tools, and standardized counter-offer email templates.
• Payment: Charged as a single, one-time payment at checkout.

B. Done-For-You (DFY) Audit ($79 Retainer Deposit + Contingency)

• Retainer Deposit: Requires an initial $79 deposit to initiate an expert review of your uploaded 3-page Loan Estimate and receive a custom ghostwritten counter-offer draft within 24 hours.
• Performance Fee Structure: If our audit successfully uncovers over $250 in negotiable lender fees (specifically within Sections A & B of your Loan Estimate), a 10% performance fee applies based on total verified savings.
• Deposit Credit & Cap: Your initial $79 deposit is applied 100% as a credit toward this 10% performance fee. Total fees owed under the DFY service are strictly capped at $300 maximum, regardless of total savings uncovered.

A. $250 Savings Guarantee

• DFY Retainer Refund: If our audit fails to identify at least $250 in negotiable lender fees or markups across Sections A and B of your submitted Loan Estimate, your initial $79 deposit will be 100% refunded upon request within 14 calendar days of delivery.
• DIY Toolkit Refund: If you utilize the DIY Toolkit and determine that your Loan Estimate presents under $250 in potential negotiable savings, you may request a full $79 refund within 14 calendar days of purchase by contacting customer support.

B. Refund Exclusions

Refunds will not be issued due to a lender's refusal to reduce fees, changes in market conditions, or a borrower's decision not to execute or submit the provided counter-offer strategy to their lender.

By using our Services, you confirm that:

1. You are the legal borrower (or authorized co-borrower) named on the official Loan Estimate uploaded to our system.
2. All information, documents, and disclosures provided to us are authentic, complete, and unedited.
3. You will review all ghostwritten drafts and ensure their accuracy before sending them to any third-party lender.

All website content, custom templates, audit frameworks, copy, logos, and materials remain the exclusive property of MyHomeBuyerWise. Purchasing a service grants you a personal, non-exclusive, non-transferable license to use the materials solely for your individual, non-commercial mortgage purchase.

To the maximum extent permitted by applicable law, MyHomeBuyerWise and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of our Services, including but not limited to lost mortgage opportunities, rate lock expirations, delayed closings, or lender decisions. Our total aggregate liability under these Terms shall not exceed the total amount paid by you to MyHomeBuyerWise.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding individual arbitration rather than court proceedings, and you agree to waive any right to participate in a class-action lawsuit.
